By accessing or using the nxtAcre farm management platform ("Service"), you agree to be bound by these Terms and Conditions. If you disagree with any part of the terms, you may not access the Service.
nxtAcre grants you a non-exclusive, non-transferable, revocable license to use the Service strictly in accordance with these Terms and Conditions.
When you create an account with us, you must provide accurate, complete, and current information. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account.
You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password.
Your use of the Service is also governed by our Privacy Policy, which is incorporated by reference into these Terms and Conditions.
nxtAcre offers an optional text-messaging program (the "Messaging Program") that delivers transactional and account-related alerts — such as invoice notifications, payment reminders, receipts, and other account- or Service-related notices — on behalf of the farms and agricultural businesses that use the Service (each, a "Sender"). All messages are sent from our toll-free number, (866) 241-3872, so you can identify them in advance and know they are legitimate and not spam. The following terms govern your participation in the Messaging Program.
Express Opt-In Consent (Double Opt-In). We do not send text messages to any mobile number until your consent has been confirmed through a two-step (double) opt-in process. Consent may be initiated in one of two ways:
In both cases, your enrollment is not complete and no alerts will be sent until you affirmatively confirm your consent. The confirmation message identifies the business on whose behalf messages are being sent.
Message Frequency. Message frequency varies and depends on your activity with the applicable Sender (for example, the number of invoices issued or alerts triggered on your account).
Message and Data Rates. Message and data rates may apply. You are responsible for any charges imposed by your mobile carrier. Carriers are not liable for delayed or undelivered messages.
Opt-Out. You may cancel the Messaging Program at any time by replying "STOP" to any message you receive. After you send "STOP," we will send a single message confirming that you have been unsubscribed, and you will no longer receive text messages from that Sender unless you re-enroll through the double opt-in process described above.
Help. For help, reply "HELP" to any message, or contact the applicable Sender or nxtAcre support.
Consent Not a Condition of Purchase. Your consent to receive text messages is not a condition of purchasing any goods or services.
Eligibility. You must be the account holder or an authorized user of the mobile number you enroll, and you must be at least 18 years of age (or have the consent of a parent or legal guardian). You agree to notify us if you change or relinquish a mobile number you have enrolled.
Our Service allows you to post, link, store, share and otherwise make available certain information, text, graphics, or other material. You are responsible for the content that you post to the Service, including its legality, reliability, and appropriateness.
The Service and its original content, features, and functionality are and will remain the exclusive property of nxtAcre and its licensors. The Service is protected by copyright, trademark, and other laws.
We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.
In no event shall nxtAcre, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days' notice prior to any new terms taking effect.
